Petition on Ethics to Send to ASHA [Archived as of 1/27/2010]

StutterTalk has noticed that there are some very positive changes being made at the LinguiSystems website (www.linguisystems.com). LinguiSystems has removed the “Outcomes Guaranteed” symbol/logo. In addition, “Guaranteed Outcomes” have been changed to “Outcomes.” We applaud Linda Bowers and Rosemary Huisingh, the co-owners of LinguiSystems, for making these very positive changes.  We also want to thank the American Speech-Language-Hearing Association (ASHA) for responding to the concerns in the petition and to the concerns I sent the Board of Directors.

We hope this is the beginning of similar changes in the way in which products and services are marketed to people who stutter by other companies and professionals. We want to thank and applaud LinguiSystems for making the changes they have made.

PETITION
We, the signatories, petition the American Speech-Language-Hearing Association (ASHA) to rigorously enforce compliance to its self-imposed Code of Ethics. In the preamble to ASHA’s Code of Ethics, the organization states that “The preservation of the highest standards of integrity and ethical principles is vital...” We agree. Therefore, we strongly urge ASHA to investigate:
 1. Whether Linda Bowers and Rosemary Huisingh, two ASHA certified speech-language pathologists and co-owners of LinguiSystems, violated the ASHA Code of Ethics with regards to the following rules under the Code of Ethics:
  • IH.  “Individuals shall not guarantee the results of any treatment or procedure, directly or by implication...”
  • IIID. “Individuals shall not misrepresent…products dispensed...”
  • IIIF. “Individuals' statements to the public…shall not contain misrepresentations.”
2. Whether, in the case described below, ASHA has adhered fully to its own Code of Ethics as it relates to relationships that the organization has with publishers, vendors and continuing education providers, as well as how ASHA accepts advertising of products and services for inclusion in its publications.
Explanation
LinguiSystems is advertising materials for stuttering therapy with an “Outcomes Guaranteed” statement claiming that the materials are “guaranteed to work.” For example, the LinguiSystems product:
  • “Fluency Card Games” is promoted with a “guaranteed outcome” to “Speak Confidently” and
  • “Easy Does It® for Fluency: Preschool/Primary” is promoted with guaranteed outcomes to “Maintain fluency in increasingly longer utterances” and to “Use easy speech in real-life speaking situations.”
Promises of cures in stuttering are widespread. Misleading advertisements and promotions not only provide people who stutter and their families with a false sense of hope not supported by evidence-based practice, but they may also mislead professionals and the public into believing that a “quick fix” is readily available for stuttering as well as other communication disorders if the appropriate materials or devices are used. ASHA must uphold the highest standards to protect customers from unethically aggressive advertising.

It is important to note that ASHA and the American Speech-Language-Hearing Foundation both receive revenue from LinguiSystems. For example, The ASHA Leader runs LinguiSystems advertisements, LinguiSystems is a vendor at ASHA conventions, LinguiSystems is an ASHA- approved continuing education provider and LinguiSystems donates tens of thousands of dollars (if not more) to the American Speech-Language-Hearing Foundation. In addition, the American Speech-Language-Hearing Foundation website prominently displays and promotes the LinguiSystems logo and website.

It is our strong belief that ASHA has a responsibility to open an inquiry into the issues raised in this letter and to create policy and oversight procedures to uphold the organization’s own ethical standards.

This is a self-obsessed organization that refuses to take a position on anything of substance--from restoring disability rights to health reform--in order to avoid any criticism that it somehow perceives as hurting its image. Do you really expect it to address ethical lapses among one of its own? Or just try to brush it under the rug, as it typically does.

    I ask for one point of clarification. In part of the petition you say 'Promises of cures in stuttering are widespread.'. Good stuff. But I did not read promises of 'a cure' in the quotes you included. I read about 'guaranteed outcomes'. Different wording which could be an obstacle. If your petition talked about 'guaranteed outcomes in any area of stuttering are just as unacceptable as promises of cures' then I agree 100%.
